1. AGREEMENT TO THESE TERMS

These Terms of Use ("Terms") are a legal agreement between you and Adrienne Troy, doing business as Mystic Fox, LLC ("Mystic Fox," "I," "me," or "my"). They apply to your access to and use of www.MysticFox.us and any related pages, content, newsletters, courses, workshops, and online services (together, the "Site").

By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

2. CHANGES TO THESE TERMS

I may update these Terms from time to time. When I do, I'll post the revised Terms on the Site and change the "Last updated" date above. If you keep using the Site after that date, you accept the changes. Changes do not affect a purchase you completed before the change unless the law allows.

3. WHO MAY USE THIS SITE

You must be at least 18 years old and able to enter into a binding agreement to use the Site or buy my services and programs. A person under 18 may receive my services only when a parent or legal guardian books the service, pays for it, and agrees to my Service Agreement and Waiver of Liability on the minor's behalf. That parent or guardian is responsible for the minor's participation and for compliance with these Terms.

4. PRIVACY

My Privacy Policy explains how I collect and use your information and is part of these Terms. Although my website platform, Squarespace, regularly backs up its data, I can't guarantee that information you submit through the Site will never be lost or corrupted, so please keep your own copies of anything important.

5. NATURE OF MY SERVICES & CONTENT

My services and content include energy healing (such as Reiki and Emotion Code®), tarot and intuitive or mediumship readings, and spiritual education. Please understand:

They are not medical, psychological, psychiatric, legal, or financial advice, diagnosis, or treatment, and are not a substitute for care from a licensed professional. Please continue any treatment or medication your providers recommend, and consult a licensed professional about health concerns.

No Guarantees I make no promise of any particular result, healing, prediction, or outcome. Readings and intuitive impressions are offered for spiritual guidance and reflection, and you remain responsible for your own decisions.

Your Own Judgment Content on the Site and in my newsletters, courses, and workshops reflects my experience and perspective, and may not suit everyone.

The full terms for individual sessions, including consent, confidentiality, and my Waiver of Liability, are in my Service Agreement. If these Terms conflict with them on the subject of a session, the Service Agreement and Waiver control.

6. PURCHASES, PAYMENTS, & REFUNDS

Accurate Information Please provide current, complete, and accurate purchase information, and keep your payment details up to date so I can complete your transactions and reach you.

Prices and Payment You agree to pay the prices in effect when you purchase and authorize me to charge your chosen payment method. Applicable sales tax will be added as required by law. All payments are in U.S. dollars and processed by third-party providers such as Square and PayPal, whose own terms and privacy policies apply to your payment.

Agreement to Purchase By clicking "Buy," "Book," "Schedule," "Purchase," "Enroll," or a similar button, or by otherwise purchasing or enrolling, you agree to purchase the product, program, or service described.

Refunds Except as stated in your Service Agreement, in the enrollment terms for a specific course, or as required by law, all sales are final and I do not give refunds for products or services purchased online. Cancellation and rescheduling of sessions are covered in the Service Agreement.

If Something Goes Wrong If you were charged incorrectly, can't access what you bought, or have another problem with a purchase, email me at MysticFox.us@gmail.com within 14 days and I'll work with you to resolve it. Depending on the situation, that may include a correction, credit, or refund, at my discretion.

Late or Failed Payment If a payment fails or is late, I may suspend your access to the related service or program, and you are responsible for the reasonable costs of collecting what you owe, including attorneys' fees where the law allows.

Errors and Refusals I may correct pricing errors, even after a payment is requested or received, and may decline any order.

7. COURSES, WORKSHOPS, & TRUE SOUL ACADEMY MATERIALS

These terms apply to Mystic Fox Academy offerings and any recordings, workbooks, handouts, and other materials ("Course Materials"):

Personal-Use License When you enroll, I grant you a limited, non-exclusive, non-transferable license to use the Course Materials for your own personal learning.

No Sharing or Resale You may not copy, share, resell, post, teach from, or otherwise distribute Course Materials, or share your login or access with others, without my written permission.

No Recording You may not record live sessions or workshops in any form without my permission.

Your Responsibility If you practice what you learn on others, you are responsible for complying with the laws that apply to you and for the care you provide.

Specific Course Terms A course may have its own enrollment terms, including refund rules. If it does, those terms control for that course.

9. INTELLECTUAL PROPERTY

Unless otherwise noted, the Site and everything on it, including text, audio, video, photographs, graphics, logos, names, course content, and materials sold on the Site (the "Content"), is owned by or licensed to me and protected by copyright, trademark, and other laws. You may not copy, reproduce, republish, post, display, distribute, sell, license, or otherwise use the Content for any commercial purpose without my prior written permission. You may view and use the Site and Content for your own personal, non-commercial use. Any use of my materials that I permit must keep the Mystic Fox logo clearly visible, if applicable.

10. ACCEPTABLE USE

You agree to use the Site only for lawful purposes. You will not:

• Break any law or infringe anyone's rights;

• Post or send anything threatening, abusive, defamatory, harassing, obscene, or invasive of someone's privacy;

• Impersonate another person or provide false information;

• Use bots, scripts, scrapers, or other automated means to access the Site or collect data from it;

• Upload viruses or harmful code, or interfere with the Site's operation or security; or

• Send spam or unsolicited commercial messages through the Site.

If you break these rules or provide false, inaccurate, or incomplete information, I may suspend or terminate your access and refuse future use of the Site.

11. TESTIMONIALS, REVIEWS, & CONTENT YOU SUBMIT

You may be able to submit reviews, testimonials, comments, photos, and other content ("Submissions"). Submissions must be lawful and not violate anyone's rights.

Permission to Use If you submit a testimonial or review, you give me permission to use, display, and share it (including on my website, newsletter, and social media). When you submit one, I'll only use your photo or identifying details with your approval. This permission is non-exclusive and royalty-free, and covers using your Submission in my marketing and other materials.

Removal You can ask me to stop using your Submission by emailing MysticFox.us@gmail.com. I'll remove it from where I control it going forward, though I can't recall copies already printed or shared by others, or on online public platforms such as Google or Yelp.

Your Promises You confirm that you own or control the rights to what you submit, that it's accurate, that it doesn't violate anyone's rights, and that you have permission from anyone identifiable in it.

Privacy Please don't post sensitive health or personal details about yourself or anyone else in a public Submission. I may edit or remove any Submission, but I'm not required to review them and am not responsible for content posted by you or others.

12. COPYRIGHT COMPLAINTS

If you believe content on the Site infringes your copyright, email MysticFox.us@gmail.com with:

1. Your physical or electronic signature (or that of the person authorized to act for the copyright owner);

2. A description of the copyrighted work you believe was infringed;

3. A description of where the material appears on the Site;

4. Your name, address, phone number, and email;

5. A statement that you have a good-faith belief the use isn't authorized by the owner, its agent, or the law; and

6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.

13. THIRD-PARTY SITES & SERVICES

The Site may link to websites, content, and services from third parties (such as Substack, Square, PayPal, and social media platforms). I don't control or review them and am not responsible for their content, accuracy, practices, or policies. Linking to a third party doesn't mean I endorse it. Your dealings with third parties, including their terms, purchases, and refunds, are between you and them.

14. SITE CHANGES, INTERRUPTIONS, & ERRORS

I may change, suspend, or discontinue all or part of the Site or its content at any time. I'm not liable for any change, price discrepancy, suspension, or discontinuance, or for downtime or interruptions. The Site may contain typos, inaccuracies, or omissions, including in descriptions, pricing, or availability, and I may correct them at any time.

15. DISCLAIMER OF WARRANTIES

To the fullest extent the law permits, the Site, its content, and my products and services are provided "as is" and "as available," and I disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use is at your own risk. I don't guarantee that the Site will be uninterrupted or error-free, or that content is accurate or complete, and I'm not responsible for viruses or harmful code transmitted by third parties, or for unauthorized access to systems or data despite reasonable safeguards.

16. LIMITATION OF LIABILITY

To the fullest extent the law permits, Mystic Fox will not be liable to you or anyone else for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, revenue, or data, arising from your use of the Site or my services, even if I've been told such damages are possible. My total liability to you for any claim will not exceed the amount you paid me for the specific product or service at issue.

Some states don't allow certain limitations or exclusions of liability, so parts of this section may not apply to you, and you may have additional rights.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold me harmless from claims, losses, and costs (including reasonable attorneys' fees) made by a third party arising from your use of the Site, your Submissions, your violation of these Terms, or your violation of anyone's rights, including intellectual property rights. I may choose to control the defense of any such claim at your expense, and you agree to cooperate.

18. ELECTRONIC COMMUNICATIONS

Visiting the Site, sending emails or texts, and completing online forms are electronic communications. You consent to receive notices and agreements from me electronically, agree that they satisfy any legal requirement that they be in writing, and agree that electronic signatures and records are valid.

19. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules.

If we have a dispute, we'll first try to resolve it informally by email at MysticFox.us@gmail.com. If we can't resolve it within 90 days, either of us may bring it to binding arbitration with the American Arbitration Association. Either of us may choose instead to bring an individual claim in small claims court within one year of the purchase date.

20. GENERAL

If any part of these Terms is found invalid or unenforceable, the rest stays in effect. My failure to enforce a provision isn't a waiver of it. These Terms, together with my Privacy Policy, and Service Agreement, and any course enrollment terms, are the entire agreement between us on their subjects. I may transfer my rights and obligations under these Terms. I'm not responsible for delays or failures caused by events beyond my reasonable control. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between us. You agree that these Terms won't be interpreted against me because I drafted them, and you waive any defense based on their electronic form or lack of a signature.
